MappyChat Member Agreement, Privacy Policy and Acceptable Conduct Policy

Version 1.0 — Effective upon account creation

This Member Agreement, together with the Privacy Policy and the Acceptable Conduct Policy set out below (collectively, the "Agreement"), forms a binding legal contract between you (the "Member", "you") and the owners and operators of MappyChat ("MappyChat", "we", "us", "our"). By ticking the acceptance checkbox during registration, by creating an account, or by otherwise accessing or using the MappyChat website, applications, maps, messaging features and related services (the "Service"), you confirm that you have read, understood and irrevocably accepted every provision of this Agreement. If you do not accept this Agreement in its entirety, you must not register for or use the Service.

1. Eligibility and Account Registration

You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction if higher, to register for or use the Service. By registering you represent and warrant that you meet this requirement, that all information you submit is true, accurate, current and complete, and that you will maintain it as such.

You are solely responsible for safeguarding your login credentials and for all activity occurring under your account, whether or not authorised by you. You must notify us immediately of any suspected unauthorised access. We may refuse, suspend or terminate any registration at our sole discretion.

One natural person or legal entity may hold one account unless we expressly agree otherwise in writing. Accounts are personal, non-transferable and may not be sold, rented, shared or assigned.

2. Nature of the Service and Location Disclosure

MappyChat displays the approximate geographic position of Members on a public or semi-public world map according to the visibility setting each Member chooses. The Service is provided for social discovery and communication purposes only.

You expressly acknowledge that publishing your location on the internet carries inherent and material risks. These risks include, without limitation: identification of your home, workplace, school or travel routine; unwanted contact, stalking, harassment, doxxing or surveillance; burglary, theft, assault, kidnapping or other physical harm; fraud, social engineering, extortion or identity theft; reputational, professional, financial, familial or immigration-related consequences; and legal exposure in jurisdictions where the disclosure or use of location data is restricted.

You choose voluntarily, knowingly and at your own risk whether to enable location sharing and which visibility level to apply. You may change your visibility setting or disable location sharing at any time from your profile. You accept full and exclusive responsibility for that choice and for every consequence flowing from it.

Location data may be inaccurate, delayed, cached, approximated or stale. The Service must never be relied upon for emergency, navigation, safety, security, medical, custodial, employment, insurance or law-enforcement purposes.

3. Assumption of Risk and Personal Liability

You are and remain solely liable for your own acts and omissions, on and off the Service, including everything you publish, transmit, upload, agree to or arrange through the Service, and including any meeting, transaction or relationship with another Member or third party.

You agree that you will not hold MappyChat, its owners, founders, shareholders, directors, officers, employees, contractors, agents, licensors, suppliers or affiliates (the "Indemnified Parties") responsible or accountable for any harm, loss, injury, damage, cost or claim of any nature arising from or connected to your use of the Service, the conduct of any other Member, or the disclosure of your location or profile information.

To the maximum extent permitted by applicable law, you irrevocably waive, release and discharge the Indemnified Parties from all claims, demands, causes of action and liabilities of every kind, whether known or unknown, present or future, and you agree that no such claim may be asserted against them before any court, tribunal, arbitral body, regulator or authority in any country. Where a jurisdiction does not permit a full waiver, this clause shall apply to the broadest extent that jurisdiction allows.

You agree to indemnify, defend and hold harmless the Indemnified Parties against any third-party claim, proceeding, penalty, damage, loss or expense (including reasonable legal fees) arising out of your use of the Service, your content, your breach of this Agreement, or your violation of any law or of the rights of any person.

4. Acceptable Conduct and Prohibited Content

MappyChat is a community service and maintains a strict prohibition on unlawful and harmful conduct. You must not use the Service, its messaging features, profile fields, links or any other functionality to discuss, promote, advertise, solicit, facilitate, arrange, depict or engage in:

  • narcotics, controlled substances, illegal drugs, precursors, prescription-medication diversion or drug paraphernalia;
  • sexual services, sexual solicitation, prostitution, escorting, pornographic or sexually explicit material, or any sexual content involving minors;
  • human trafficking, forced labour, smuggling of persons, kidnapping, servitude or exploitation of any kind;
  • weapons, firearms, ammunition, explosives, chemical, biological or radiological materials, or instructions for producing them;
  • terrorism, violent extremism, incitement to violence, threats, hate speech, harassment, stalking, bullying or self-harm promotion;
  • fraud, scams, money laundering, counterfeit goods, stolen data or credentials, hacking, malware or unauthorised access;
  • the sale, scraping, harvesting, resale or automated collection of Member data, including locations, photographs and messages;
  • impersonation, false identity, spam, bulk messaging, commercial solicitation without permission, or the use of bots and automated agents;
  • any other activity that is illegal in your jurisdiction, in the jurisdiction of the recipient, or in the jurisdiction from which the Service is operated.

These prohibitions apply irrespective of whether the conduct is lawful where you are located, and irrespective of intent, humour, hypothetical framing or roleplay.

5. Enforcement, Suspension, Blocking and IP Bans

Where we determine, in our sole and absolute discretion, that a Member has breached this Agreement or presents a risk to the community, we may without prior notice and without liability: remove or edit content; restrict, hide or reset map visibility; suspend, block, deactivate or permanently delete the account; forfeit any remaining paid membership period without refund; ban the associated IP address, address range, device or network; and refuse all future registrations connected to that Member.

The owners of MappyChat are the sole and final decision makers as to who is banned. No investigation, evidence, warning, hearing, appeal, explanation or notice period is owed to any Member. Members may be banned at any time, for any reason or for no stated reason, and such decisions are final and not subject to review.

Where required or permitted by law, we may report unlawful conduct and disclose relevant account, message, device and location records to law enforcement or competent authorities.

6. Privacy Policy — Data We Process

We process the following categories of personal data:

  • Account data: name, email address, password hash, membership tier and billing status.
  • Profile data: profile photograph, biography, personal or company link, job title, company name, work status and any optional free-text field you complete.
  • Location data: approximate latitude and longitude reported by your device or browser, together with the time of the last update and your chosen visibility level.
  • Communications data: private messages, friend requests and related metadata.
  • Technical data: IP address, device and browser characteristics, session identifiers, log records and security events.
  • Payment data: subscription status and identifiers supplied by our payment processor. We never receive or store full card numbers.

7. Privacy Policy — Purposes, Legal Bases and Sharing

We process personal data to operate and secure the Service, to render the map and messaging features, to apply your privacy settings, to administer memberships and payments, to prevent abuse and fraud, to enforce this Agreement and to comply with legal obligations. Depending on your jurisdiction, our legal bases are performance of a contract, your consent (in particular for location sharing), our legitimate interests in operating a safe service, and compliance with law.

Data displayed on the map is disclosed to other Members and, where you select a public visibility level, to unregistered visitors, strictly according to the visibility option you choose. We additionally share data with infrastructure, database, hosting, map-tile, email and payment providers acting as processors on our behalf, and with authorities where legally required. We do not sell personal data.

Data may be transferred to and processed in countries other than your own, including countries whose data-protection regime differs from that of your residence. By using the Service you consent to such transfers.

8. Privacy Policy — Retention, Security and Your Rights

We retain account, profile and message data for as long as your account exists and thereafter for as long as necessary to comply with legal obligations, resolve disputes, and enforce bans and security measures. Security event and IP records associated with enforcement actions may be retained indefinitely for the purpose of upholding bans.

We apply technical and organisational safeguards including encryption in transit, access controls and row-level database security. No system is completely secure, and we cannot guarantee that unauthorised access, interception or data loss will never occur.

Subject to applicable law, you may request access to, correction of, or deletion of your personal data, restrict or object to certain processing, withdraw consent to location sharing (by changing your visibility setting or disabling location), and request a copy of your data. You may exercise most of these rights directly from your profile page, or by contacting us. Deleting your account removes your profile and map presence; messages already delivered to other Members and records retained for legal or security purposes may persist.

We use only cookies and local storage that are strictly necessary for authentication and session management.

9. Memberships, Payments and Refunds

Paid membership tiers renew automatically each month until cancelled. You may cancel at any time; cancellation takes effect at the end of the current paid period, after which your account reverts to the free tier and your map appearance returns to the standard free-member style. Except where required by mandatory law, payments are non-refundable, including where an account is suspended or banned for breach of this Agreement. Prices may change on notice for subsequent billing periods.

10. Intellectual Property and Member Content

The Service, its software, design, trademarks and content are owned by MappyChat and its licensors. You retain ownership of the content you submit, and you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display and transmit that content solely for the purpose of operating and promoting the Service. You warrant that you hold all rights necessary to grant this licence and that your content infringes no third-party right.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranty of any kind, express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We do not verify the identity, statements, photographs, intentions or background of any Member, and some profiles may be demonstration profiles. Any interaction with another Member is undertaken entirely at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, the Indemnified Parties shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, nor for loss of profit, data, goodwill, opportunity or personal safety, arising from or connected to the Service, whether based in contract, tort, statute or otherwise, even if advised of the possibility of such damages. Our aggregate liability for all claims shall not exceed the greater of (a) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty United States dollars (USD 50). Nothing in this Agreement excludes liability that cannot be excluded by law.

13. Governing Law, Disputes and Severability

This Agreement and any dispute arising from it are governed by the laws applicable at the place of establishment of the owners of MappyChat, without regard to conflict-of- law rules, and the courts of that place shall have exclusive jurisdiction to the extent permitted by law. You agree to bring claims only on an individual basis and not as part of any class or representative proceeding. If any provision of this Agreement is held invalid or unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right shall not constitute a waiver of it.

14. Changes to this Agreement

We may amend this Agreement at any time. Material changes will be indicated by an updated version note on this page. Your continued use of the Service after changes take effect constitutes acceptance of the amended Agreement. If you do not accept the changes, you must stop using the Service and delete your account.

15. Acknowledgement

By ticking the acceptance checkbox at registration you confirm that you have read and understood this Agreement in full; that you accept sole liability for your own actions; that you are aware of and voluntarily assume the risks of publishing your location; that you will not hold MappyChat accountable in any court in any country; that you will not use the Service to discuss or facilitate illegal activity including drugs, sexual services, prostitution, trafficking or weapons; and that your account and IP address may be blocked at any time, at the sole discretion of the owners of MappyChat, without prior notice.
